AchooAllergy.com reserves the right to cancel any orders for products excluded from this promotion placed online that incorrectly reflect a
10% discount.
The winner will be selected in a random drawing on January 12, 2010, and
the winner will be published on AchooAllergy.com on the same day. The
winner will be notified via email, telephone, or certified mail.
Potential winners will have five days from the date of said notification
to respond to such notification. Potential winners must sign an
Affidavit of Eligibility and Liability and Publicity Release before
claiming the prize. Failure to comply with the official rules, failure
to respond to notification within five days, or failure to sign required
forms will result in disqualification, at which time another winner will
be selected at random.
Sponsor is not responsible for lost, interrupted, or unavailable
network, server, or other connections; miscommunications; failed
telephone, computer hardware, computer software, or other technical
failures; unauthorized human intervention; or other errors of any kind,
whether human, electronic, or otherwise.
By entering this sweepstakes, entrant agrees to indemnify, hold
harmless, and release sponsor, affiliates, vendors, and promotional
agencies and all officers, directors, employees, representatives, and
agents from any liability, damages, losses, or injury resulting directly
or indirectly from entrant's participation in sweepstakes and
acceptance, possession, or use/misuse of any prize. Sponsor, affiliates,
vendors, and promotional agencies disclaim any liability for damage to
any computer system of other property resulting from access to or
downloading of any materials connected to the sweepstakes. Entrant
agrees that any and all claims, judgments, and awards will be limited to
actual out-of-pocket costs (not including attorneys' fees,
disbursements, or court costs) and under no circumstances will entrant
be permitted to obtain awards for, and entrant hereby waives all rights
to claim any damages, other than for actual out-of-pocket costs.
By entering this sweepstakes, entrant grants sponsor permission to use
entrant's name, address (city/state only), likeness, and comments for
advertising and publicity purposes, without any further notice or
compensation, except where prohibited by law.
Sponsor reserves the right, at its sole discretion, to
cancel/suspend/modify the sweepstakes if it becomes corrupted in any
manner such that it cannot be conducted as originally planned and, in
such event, to select winners by random drawing from all eligible
entries received prior to and/or after (if appropriate) the action taken
by sponsor. No prize transfer or cash substitutes allowed except at
sponsor's sole discretion due to prize unavailability for any reason and
only then for a prize of equal or greater value. Winners take sole
responsibility for taxes on prizes. Copying or unauthorized use of
copyrighted materials, trademarks, or any other intellectual property
without express written consent of owner is strictly prohibited.
Except where prohibited, entrants agree that any and all disputes,
claims, and causes of action arising out of or connected with the
sweepstakes, or any prize awarded, or the determination of the winner
shall be resolved individually, without resort to any form of class
action; any and all claims, judgments, and awards shall be limited to
actual out-of-pocket costs incurred, including costs associated with
entering this sweepstakes but in no event attorney’s fees; and under no
circumstances will entrant be permitted to obtain awards for and entrant
hereby waives all rights to claim punitive, incidental and consequential
damages and any other damages, other than for actual out-of-pocket
expenses, and any and all rights to have damages multiplied or otherwise
increased. If, after 30 days of good faith efforts to negotiate a
resolution, a claim, issue or dispute arising in respect to the
sweepstakes still exists, entrant agrees that it will be conclusively
resolved without right of appeal by binding arbitration conducted in
Georgia according to the commercial arbitration rules of the American
Arbitration Association. All issues regarding the construction,
validity, interpretation, and enforceability of these official rules or
the rights and obligations of entrants and sponsor as related to this
sweepstakes shall be governed, and construed in accordance with the laws
of the State of Georgia, without regard for conflicts or law doctrine,
and all proceedings shall take place in that state. All federal, state,
provincial, and municipal laws apply.
